The E-3 visa
E-3 visas are for Australian citizens to pursue employment in the U.S. E-3 visas are similar to H-1B visas in their basic structure with some notable differences. Spouses and children of E-3 employees may apply for E-3 Dependent (E-3D) visas. E-3 spouses are entitled to work in the United States. upon admission to the United States in E-3S status.
- E-3 Sponsorship
Departments who may wish to hire or retain faculty and highly specialized scientific staff should complete the E-3 Employee Request e-forms in Sunapsis so the Office of International Services can determine whether E-3 eligibility criteria are met.
Acquiring E-3 status
If eligible, OIS will either file a petition with USCIS or provide guidance on how to obtain E-3 status from overseas.
Process for Employees Outside the US

OIS STAFF will review, complete, and submit a Labor Condition Application (LCA) to the U.S. Department of Labor (DOL).

Once the LCA is certified, OIS will provide a copy with a list of documents required to apply for an E-3 visa at a U.S. Consulate.

Once the E-3 visa is issued, the employee can travel to the US.
Process for Employees Inside the US

OIS will review, complete, and submit a Labor Condition Application (LCA) to the U.S. Department of Labor (DOL).

Once the LCA is certified, OIS will submit a petition to the USCIS to obtain or extend their E-3 status. The hiring department is responsible for paying the $510 filing fee and $2,805 premium processing fee.

The employee can begin work at UMB on the petition start date once approval notice arrives.
